› Introduction

In Canada, legislation regarding environmental and transport issues is set on the federal or provincial level. The main actors on the federal level are Environment Canada and Transport Canada. They coordinate the central government's environmental policies and programmes for the country as a whole, carry out research and impact assessments, and enforce regulation.

In addition, the Canadian Constitution gives the 10 provinces authority to make laws concerning local nature within their territory.

› Overview

At present there is no law setting numerical limits for working fluids contained in Mobile Air Conditioners (MAC). However, there are several legislative sources and agreements that will serve as a future basis for regulating the automotive sector and MAC:

  • Fuel Efficiency Standards: Applicable to the automotive sector they are based on a voluntary commitment of carmakers to meet the U.S. CAFE Standard. The Canadian equivalent CAFC goal is expected to be replaced by more stringent mandatory standards in the near future.

  • Memorandum of Understanding: Agreed between the Canadian government and the car industry, it is based on a voluntary commitment to limit vehicles’ greenhouse gas emissions by 5.3 million tonnes of CO2 equivalent by 2010, based on a reference case of 90.51 million tonnes.

  • Clean Air Act: The new act will amend existing fuel consumption standards to set strict national limits for new cars. The voluntary Memorandum of Understanding will be replaced by legal enforcement under this long-term strategy to tackle climate change.
